When a Motion for Continuance is filed, does the attorney and defendant need to be present?
Yes – both the attorney and defendant must be present at the time of the court’s setting, unless the Court has made contact with all counsel of record advising continuance was granted. The filing of a continuance does not constitute an automatic granting of the continuance.
