ORDINANCE NO. 2023-16
AN ORDINANCE OF THE CITY OF DONNA, TEXAS, CALLING A GENERAL MUNICIPAL ELECTION FOR TUESDAY, NOVEMBER 7, 2023, TO BE PARTICIPATED IN BY THE QUALIFIED VOTERS OF THE CITY OF DONNA, TEXAS, FOR THE PURPOSE OF ELECTING THE POSITIONS OF MAYOR, COUNCILMEMBER PLACE 1, COUNCILMEMBER PLACE 3 AND MUNICIPAL JUDGE DESIGNATION OF ELECTION PRECINCTS, POLLING PLACES, METHOD OF VOTING AND PROVIDING FOR EARLY VOTING AND ELECTION NOTICE.
WHEREAS, the Mayor and the City Council in their capacity as City Officials and in compliance with the City's Charter and the Texas Election Code, may call a General Municipal Election; and
WHEREAS, the office of the present Mayor, Councilmember Place 1, Councilmember Place 3 and Municipal Judge, will expire in November 2023.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF DONNA, TEXAS, THAT:
Pursuant to and in compliance with the provisions of the City's Charter, the Texas Election Code, and the laws of the State of Texas, a General Municipal Election will be held in the City of Donna, Texas, on Tuesday, November 7, 2023 for the purpose of electing Mayor, Councilmember Place 1, Councilmember Place 3 and Municipal Judge. Notice of same election shall be given by the City Secretary by posting a properly executed copy of this election ordinance and notice for a period of thirty (30) days before the date of said election at City Hall in Donna, Texas; and
That no irregularity in the notice herein provided shall invalidate said notice, and; that any candidate for City Council may have their name placed on the official ballot by complying with the provision of the City Charter, and with the pertinent provisions of the Texas Election Code; and
All candidates for the above offices must file their application for a place on the ballot with the City Secretaiy in the manner required by the City's Charter, the Texas Election Code, and the laws of the State of Texas.
The Mayor, City Secretaiy and Chief of Police ai·e hereby authorized and instructed to perform their respective duties in connection with said election imposed upon them by this Ordinance, the City Charter of the City of Donna, Texas and the Texas Election Code.
All of the City of Donna's voting precincts 3, 23, 45, 55, 87, 120, 157,163, 171, 172, 173, 174 175, 225 and 232 shall be designated to the following voting poll location for Early Voting as follows:

The following designated voting poll location shall on said Election Day remain open from 7:00 a.m. to 7:00 p.m. for designated precincts:

Precincts: 3, 23, 45, 55, 87, 120, 157, 163,171, 172, 173, 174,175,225,232
The City of Donna shall contract with the County Election Officer to perform the election services in the General Election of November 7, 2023, pursuant to the Texas Election Code, Section 31.092(a). Pursuant to the Texas Election Code, Section 31.091(1), the County Election Officer means the Elections Administrator for Hidalgo County.
Said city election shall be held in accordance with the laws of the State of Texas and only residents residing within the city limits of Donna that are qualified voters of said special city election shall be eligible to vote at said special city election.
Said election shall be conducted by the use of Hart Intercivic Voting System, including ballots cast by early personal appearance. The voting system used has been certified by the Office of the Texas Secretary of State in accordance with the Election Code of the State of Texas.
In the event that no candidate for a place or position receives a majority of the votes cast for such place of position, or in the event of a tie vote, there shall be a rnn-off election ordered in accordance to the laws of the State of Texas.
Notice of said city election shall be given in accordance with the City Charter and the Texas Election Code not earlier than the 30th day or no later than the 10th day before Election Day in a newspaper of general circulation. Also, a copy of the election notice shall be posted, not later than the 19th day before Election Day, at a public place.
All notices, official publications, ballots, sample ballots, and voter instmction used in connection with this election shall be ptinted in both English and Spanish.
Effective date will be immediately upon its passage and execution in accordance with the Charter of the city of Donna and otherwise by law.
If any section or part of any section paragraph or clause of this Ordinance is declared invalid or unconstitutional for any reason such declaration shall not be held to invalidate or impair the validity, force or effect of any other section, part of any section, paragraph or clause of this Ordinance.
Passed and approved on the first reading on this the 6th day of June 2023.
