CITY OF EDINBURG
AN ELECTION IS HEREBY ORDERED TO BE HELD ON NOVEMBER 02, 2021 FOR THE PURPOSE OF:
AMENDMENT TO THE CITY CHARTER OF THE CITY OF EDINBURG, TEXAS
POR LO PRESENTE SE ORDENA QUE SE LLEVARA ACABO UNA ELECCIÓN EL DIA 02 DE NOVIEMBRE, 2021 CON EL PROPOSITO DE: ENMIENDA A LOS ESTATUATOS DE LA CIUDAD DE EDINBURG, TEXAS
Amendment No.1: Adding ARTICLE XVII, SECTION 14. SUSPENSION FROM OFFICE, to be read as follows:
1. Any elected official of the City may, by a majority vote of the members of City Council not including the elected official who is the subject of the removal, be suspended from office upon that elected official being indicted for a felony while serving as an elected official of the City.
2. The elected official against whom removal is sought shall be entitled to reasonable notice that the issue of his or her suspension shall be heard by City Council and shall be permitted to testify in his or her own behalf and present such other relevant evidence as determined by the majority of the other members of Council at such Council meeting.
3. Council shall be the sole judge of the grounds constituting suspension from office. Council shall initiate the process to establish grounds for suspension from office by motion.
4. Upon a vote by a majority of the members of Council, other than the elected official who is the subject of the suspension, that grounds exist which subject such elected official to suspension from office, Council shall instruct the City Secretary to notify the elected official in writing of such suspension.
5. Such suspension shall terminate upon (a) the dismissal of the indictment; (b) a conviction for a crime other than a felony; or ( c) a conviction for a felony.
This Section shall not apply to felony indictments that occurred prior to enactment of this Section.
ENMIENDA NUM. 1: Añadiendo ARTÍCULO XVII, SECCIÓN 14. SUSPENSIÓN DEL CARGO, para que lea como sigue:
1. Un funcionario electo de la Ciudad puede, por mayoria de votos de los miembros del Concejo Municipal, sin incluir al funcionario electo que es el sujeto de la destitución, ser suspendido de su cargo cuando ese funcionario electo sea acusado de un delito grave mientras se desempenaba como funcionario electo de la ciudad.
2. El funcionario electo contra quien se solicita la destitución tendra derecho a un aviso razonable de que el asunto de su suspension sera escuchado por el Concejo Municipal y se le permitira testificar en su propio nombre y presentar cualquier otra evidencia relevante segun se determine por la mayoria de los demas miembros del Consejo en dicha reunion del Consejo.
3. El Consejo sera el unico juez de los motivos que constituyan la suspension del cargo. El consejo iniciara el proceso para establecer los motivos de suspension del cargo por mocion.
4. Tras una votacion de la mayoria de los miembros del Consejo, que no sea el funcionario electo que es el sujeto de la suspension, que existen motivos que sujetan a dicho funcionario electo a la suspension de su cargo, el Consejo instruira al Secretario de la Ciudad que notifique a los electos oficial por escrito de dicha suspension.
5. Dicha suspension terminara con (a) la desestimacion de la acusacion; (b) una condena por un delito que no sea un delito grave; o ( c) una condena por un delito grave.
6. Esta Seccion no se aplicara a las acusaciones por delitos graves que ocurrieron antes de la promulgacion de esta Seccion.
Early voting by personal appearance will be conducted Monday through Friday at:
Hidalgo County Elections Annex Building (Warehouse Room), located at 317 North Closner Boulevard (North Entrance), Edinburg, Texas; and University of Texas-Rio Grande Valley, Student Academic Center (UTRGV-STAC Lounge) located at 1201 West University Drive, Edinburg, Texas beginning on Monday, October 18, 2021 through Friday, October 29, 2021 between the hours of 7:00 a.m. and 7:00 p.m.; and weekend early voting will be held on Saturday, October 23, 2021 from 7:00 a.m. to 7:00 p.m., and Sunday, October 24, 2021 from 10:00 a.m. to 3:00 p.m.
La votación anticipada en persona se llevará a cabo de lunes a viernes en:
Edificio Anexo de Elecciones del Condado de Hidalgo (Sala de Almacén), ubicado en Norte Bulevar Closner No. 317 (Entrada Norte), Edinburg, Texas; y la Universidad de Texas-Rio Grande Valle-Centro Académico Estudiantil (Salón-STAC), ubicado en Oeste Calle University No. 1201, Edinburg, Texas a partir del lunes 18 de octubre de 2021 hasta el viernes 29 de octubre de 2021 entre las horas de 7:00 am y las 7:00 pm; y la votación anticipada de fin de semana se llevará a cabo el sábado 23 de octubre de 2021 de 7:00 a.m. a 7:00 p.m., y el domingo 24 de octubre de 2021 de 10:00 a.m. a 3:00 p.m.
The polling places, as well as, the days and hours of operation are subject to change as they are to be determined by the Hidalgo County Elections Department.
Los lugares de votación, asi coma los dias y horas de operación, están sujetos a cambios ya que serán determindados por el Departamento de Elecciones del Condado de Hidalgo.
Applications for ballot by mail shall be mailed to: Yvonne Ramon, CERA, Hidalgo County Elections Department, 213 South Closner Boulevard, Edinburg, Texas 78539, for registered voters residing within the Edinburg City limits.
Las solicitudes para boletas que se votaran en ausencia por correo deberán enviarse a: Yvonne Ramon, CERA, Departamento de Elecciones del Condado de Hidalgo, Sur Bulevar Closner No. 213, Edinburg, Texas, 78539, para votantes registrados que residen dentro de las limites de la ciudad de Edinburg.
Applications for ballots by mail must be received, not simply postmarked, no later than 7:00 p.m. on October 22, 2021.
Las solicitudes para boletas que se votaran en ausencia par correo deberán ser recibidas, no sellado par correo postal, para las 7:00 p.m. el dia 22 de octubre del 2021.
